Terms & Conditions

These Terms & Conditions (“Terms”) govern access to and use of websites and services operated by DWET PVT LTD (“DWET Labs”, “we”, “us”, or “our”), including the company site (https://dwetlabs.com), Oogam product surfaces at https://oogam.in and https://oogam.ai, and Oogam Platform at https://platform.oogam.in (together, the “Services”).

By creating an account, purchasing credits or plans, or otherwise using the Services, you agree to these Terms and our Privacy Policy and Refund Policy.

1. Who we are

The merchant / service provider is DWET PVT LTD, India. Oogam is our flagship AI product. Branding may appear as DWET Labs or Oogam; contracts and invoices are issued by DWET PVT LTD.

2. Eligibility

You must be at least 18 years old and capable of entering a binding contract under Indian law. If you use the Services on behalf of an organisation, you represent that you are authorised to bind that organisation.

3. Accounts

• You are responsible for accurate registration information and for keeping credentials and API keys confidential.
• You are responsible for all activity under your account, unless caused by our proven security failure.
• We may suspend or terminate accounts that violate these Terms or pose security, legal, or abuse risk.

4. Services description

Oogam provides AI-powered features such as chat, voice, code, and work/agent experiences. Oogam Platform provides developer access (including API keys, usage metering, credits/wallet, and billing). Features may change as we improve the product. Early or beta features may be labelled as such and may be incomplete.

5. Acceptable use

You agree not to:

• Use the Services for unlawful, harmful, fraudulent, or abusive purposes.
• Attempt to reverse engineer, disrupt, or overload the Services, or bypass rate limits / security controls.
• Infringe intellectual property, privacy, or other rights of others.
• Upload malware or attempt unauthorised access to systems or data.
• Misrepresent your identity or affiliation, or resell access except as expressly permitted in writing.

We may investigate violations and suspend or terminate access without refund where misuse is found (see Refund Policy for related rules).

6. Fees, credits, and payments

• Paid plans, top-ups, and usage-based charges are shown at checkout or in the Platform console before you confirm payment.
• Payments are processed by Razorpay (or another authorised payment partner). You authorise us and our payment partner to charge the selected payment method for the stated amount, taxes (if applicable), and any recurring charges you enable.
• After payment, Razorpay (or our systems) may redirect you to a return/callback URL on https://oogam.in (or related Oogam domains) so we can confirm payment status and fulfil your order (for example credit your wallet).
• Prices are generally in INR unless otherwise stated. Applicable taxes (including GST) may be added as required by law.
• Credits and prepaid balances are for use on Oogam / Platform only, are non-transferable, and expire only if we clearly state an expiry at purchase time.

7. Refunds and cancellations

Refunds and cancellations are governed by our Refund Policy, which forms part of these Terms.

8. Intellectual property

We and our licensors own the Services, branding, models, software, and documentation. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the Services. You retain rights in content you submit, and grant us a licence to process that content solely to provide and secure the Services.

9. AI output disclaimer

AI outputs may be inaccurate, incomplete, or inappropriate. You are responsible for reviewing outputs before relying on them, especially for legal, medical, financial, or other high-stakes use. The Services are provided “as is” to the maximum extent permitted by law.

10. Confidentiality and customer data

We treat account and billing data as confidential and handle personal data as described in the Privacy Policy. You are responsible for ensuring you have the right to submit any data you provide to the Services.

11. Third-party services

The Services may interoperate with third parties (including Razorpay and identity providers). We are not responsible for third-party services outside our reasonable control. Your use of Razorpay is also subject to Razorpay’s terms.

12. Limitation of liability

To the maximum extent permitted by Indian law, DWET PVT LTD is not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill. Our aggregate liability for any claim relating to the Services is limited to the amounts you paid us for the Services in the three (3) months before the claim, or INR 5,000, whichever is higher, except where liability cannot be limited by law (for example proven fraud or wilful misconduct).

13. Indemnity

You agree to indemnify and hold DWET PVT LTD harmless from claims arising out of your misuse of the Services, your content, or your violation of these Terms or applicable law.

14. Suspension and termination

You may stop using the Services at any time. We may suspend or terminate access for breach, non-payment, legal risk, or service discontinuation. Sections that by nature should survive (including IP, payment obligations already incurred, liability limits, and governing law) will survive termination.

15. Changes to the Services or Terms

We may update the Services and these Terms. Material changes will be indicated by updating the “Last updated” date and, where appropriate, by notice in-product or by email. Continued use after changes means you accept the updated Terms.

16. Governing law and disputes

These Terms are governed by the laws of India. Courts in India shall have exclusive jurisdiction, subject to any mandatory consumer protections that apply to you.
